Rumours that the Hannah Montana star is seeking legal advice and wants to divorce her parents are 'completely false' said her publicist.
However, if the rumours were true Miley would be joining a long list of famous youngsters who have already done so.
As a teenager, actress Drew Barrymore sued for legal freedom from her mum Jaid in 1991. Other child stars who were granted the same emancipation include Courtney Love, Alicia Silverstone, Michelle Williams, Jamie Pressly and Rose McGowan.
Which means, that in the eyes of family law a child has no obligation to obey their parents and wouldn't incur any punishments like confiscation and grounding, for example.
When Jamie Pressly divorced her parents she told Playboy, 'I was in hormone hell, so going to Japan on a modeling contract seemed like a great escape. Neither of my parents could come with me, and in order to get out of school for that semester and go on my own without a legal guardian, the child labor laws said I needed to be an emancipated minor. ... It wasn't about my parents; it was about my wanting to get the hell out of Dodge.'
There are some benefits to being an emancipated child star, once granted legal freedom child stars needn't worry about their parents mishandling the career and earnings. They can also work longer hours making them more appealing to casting agents which is why Michelle Williams successfully filed her request at the age of 15.
